Real Estate Disputes with Developers in New Cairo

In short

Mohamed Moawad Legal Consultancy & Advocacy represents unit buyers in New Cairo and across Greater Cairo in disputes with real estate developers arising from contracts and unit handovers: delayed delivery, units that differ from the contract, refunds and contract cancellation. Cases are led by Counselor Mohamed Moawad Abdel Tawab, a former Court President.

What we handle

Cases we handle

  • Delayed handover

The developer has missed the delivery date in your contract.

  • Unit differs from the contract

The area, finishing, specifications or location differ from what was agreed.

  • Cancellation and refunds

Ending the contract and recovering what you paid, with compensation where due.

  • Delay penalties and compensation

Claiming the penalty agreed in the contract, or compensation for your loss.

  • Disputed fees and charges

Maintenance deposits, late-payment charges and other amounts you dispute.

  • Validating the contract and transferring title

Claims to confirm your sale contract and complete the transfer of ownership.

How we work

From first consultation to judgment

  1. Consultation

We review your contract, payments and correspondence with the developer, and tell you plainly where you stand.

  2. Formal notice

Where needed, we send the developer a formal notice that records your rights and preserves them.

  3. Negotiation

A dispute can settle once the developer sees a well-prepared file, so we negotiate before going to court when it serves you.

  4. Court

If needed, we file the case and represent you from first instance to appeal, and keep you informed at each step.

Before you visit

Documents to bring

Copies are enough; keep the originals with you.

  • The reservation form and sale contract, with all annexes
  • Payment receipts and the instalment schedule
  • The brochure or advertisement you relied on
  • Letters and messages exchanged with the developer
  • The handover report and photos of the unit, if you have received it

Questions

Frequently asked questions

  • The unit doesn't match the contract. Should I sign the handover report?

Inspect the unit before signing and record every difference from the contract in the handover report itself, or in a separate letter to the developer. Signing a report that says the unit was received in good condition can make a later claim harder. If you are unsure, talk to us before you sign.

  • Do you only take cases in New Cairo?

Our office is in the Fifth Settlement, New Cairo, and we take cases for clients across Greater Cairo.
